ANDREW Moore’s appeal of a three-week suspension has failed.
Moore’s suspension for making contact with an umpire will stand and he’ll be sidelined until the Magpies face the Crows in Round 7.
Judge Michael David said the penalty was severe but not excessive.
Port Adelaide Counsel Mark Griffin attempted to argue Moore was simply trying to explain the situation.
“Moore explained in the course of the discussion, Andrew Moore demonstrated all that he done to his opponent. In a sense explaining to the umpire why it shouldn’t have been a free kick. It was not a push or a shove, it was a discussion about had happened,” Griffin said.
“The umpire thought nothing of the touch at all, so much so that it didn’t even register in his memory.
“To suffer that punishment given the circumstances, it’s excessive. There could still be a considerable deterrent with a reprimand and a significant fine, which Mr Moore would pay.”
Moore was disappointed with the outcome, but accepted the decision.
"I pleaded guilty, so clearly I accept that no matter what the circumstances, you should never touch an umpire," Moore said after the hearing.
"I'm disappointed, but I accept the decision and we move on."
